Terms of Service

Welcome to positioned.careers. These Terms of Service (“Terms”) govern your use of positioned.careers (the “Service”), operated by ACT Power (“we,” “us”). By creating an account, you agree to these Terms.

1. What positioned.careers is

positioned.careers is a career-positioning platform: you provide your career story and existing resumes, the system builds a fact-based profile from them, and generates a resume tailored to a specific job posting you provide. Every generated resume is checked against your own stated facts before it’s released to you (the “audit gate”).

2. Acceptable use

You agree not to:

  • Scrape, reverse-engineer, or attempt to extract the resume-generation or audit-gate logic
  • Upload a resume, career story, or identity information belonging to someone other than yourself
  • Use the Service for any unlawful purpose, or to generate content containing false credentials, degrees, or work history

3. Your content and your generated resume

You retain full ownership of the career content you provide (resumes you upload, your career story) and of every resume the Service generates for you; it’s your career document, built from your own facts. positioned.careers owns the platform, the generation pipeline, and the underlying system, not your output.

You grant positioned.careers a limited license to process your content solely to operate the Service (generating, auditing, and storing your resumes).

4. Credits and payment

  • The Service is pack-based: you purchase a pack of credits and spend one credit per resume generation. There is no subscription and no free tier beyond any trial credits offered at signup.
  • Credits never expire.
  • All purchases are final. We do not offer refunds on purchased credit packs, whether used or unused.
  • Revision rounds on a resume you’ve already generated (up to the limit shown in-product) do not cost additional credits.

5. AI-generated content: what we do and don’t promise

Your resumes are generated by an AI system, built entirely from the facts and career content you provide, and checked by a separate audit step before release. We do not guarantee:

  • That a resume will result in an interview, offer, or any specific employment outcome
  • That every possible error is caught; you’re responsible for reviewing your resume before submitting it to an employer

The audit gate is a real safeguard, not a promise of perfection: it checks that every claim in your resume traces back to something you told us, not that the resume will get you the job.

6. Limitation of liability

To the maximum extent permitted by law, positioned.careers is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any employment outcome. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

7. Indemnification

You agree to indemnify positioned.careers against claims arising from content you upload that infringes another person’s rights or misrepresents your own identity or credentials.

8. Account termination and your data

You may delete your account at any time from Account settings. On deletion:

  • When you delete your account, your data is erased immediately and cannot be recovered. Download any resumes you want to keep before you delete your account.
  • Unused credits are forfeited on deletion (consistent with our no-refund policy above).

9. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

10. Changes to these Terms

We may update these Terms from time to time. We’ll update the effective date above when we do, and material changes will be flagged in-product.
